This cause of action claimed damages as a result of denial of plaintiff's fair housing rights under the Fair Housing Act, 42 U.S.C. §Â§ 3604 and 3617 and the Civil Rights Act of 1866, 42 U.S.C. §Â§ 1981 and 1982. Defendant responded to plaintiff-appellant's complaint by filing a motion for summary judgment which the District Court granted dismissing the 1866 Civil Rights Act claim on statute of limitations grounds, and the Fair Housing Act complaint on the grounds that Ohio law provides state judicial remedies for housing discrimination equivalent to those provided by the Fair Housing Act.
